SmartD Technologies Inc (“SmartD Technologies“) (“we,” “our,” or “us”) respects your privacy and is committed to protecting it through our compliance with this policy.

This Privacy Policy describes the types of information we may collect from you or that you may provide when you use the Clean Power VFD mobile application (the “App”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. It also explains how you can exercise your rights, including when you wish to access your information or require us to correct it.

By installing and using the App, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. You may withdraw your consent at any time by contacting us; however, doing so may limit or prevent use of the App.

1. INFORMATION WE COLLECT AND HOW IT IS PROCESSED

When you access or use the App, we collect specific data points to ensure functionality, analyze performance, and improve user experience. We categorize this data based on how it is stored and processed:

A. Data Transmitted Directly to Your Equipment (VFD)

The App facilitates a direct connection between your mobile device and your Variable Frequency Drive (“VFD”). SmartD Technologies does not intercept, store, or retain the data transmitted during this connection. The following information is sent from your mobile device directly to the VFD’s local memory to facilitate configuration:

  • Timezone: We collect your device’s timezone settings to synchronize timezone with our VFD when no internet connection is available.

  • Device Manufacturer: The brand of the device you are using (e.g., Apple, Samsung).

  • Device Model: The specific model of your device (e.g., iPhone 15, Pixel 8).

  • Device OS Version: The specific version number of the operating system running on your device (e.g., iOS 17.2, Android 14).

  • Device Name: The user-assigned name of the device (e.g., “John’s iPhone”).

B. Data Stored Locally on Your Device

The App processes certain data locally on your mobile device. We do not transmit this data to external servers:

  • Device OS Name: The name of the operating system (e.g., iOS, Android).

C. Data Shared with Third-Party Service Providers (Crashlytics)

We do not own or operate internal servers for data collection. However, we use Google Firebase Crashlytics to monitor the stability of our App. When the App is used, or in the event of a crash or error, the following specific data points are shared with Google Crashlytics:

  • Performance Data: Information regarding the installation, use of, engagement with, and functionality of the application, including reporting on errors or bugs.

  • Device State Information: Data about the status and conditions of the device (e.g., memory usage, battery level, orientation) at the time of an event or crash.

  • Unique Device Identifiers: Specific identification codes (such as an Installation UUID) used to distinguish one device from another for analytics purposes.

  • Physical Location: Information relating to where the device is located geographically at the time of an event. Approximate location only is used (timezone).

  • Application Usage: Information about how you interacted with or used the application leading up to an event (e.g., screen views, button clicks).

2. HOW WE USE YOUR INFORMATION

We use the information categorized above to:

  • Present our App and its contents to you.

  • Diagnose technical problems, crashes, and bugs using third-party tools.

  • Analyze usage trends to improve future updates.

3. DISCLOSURE OF YOUR INFORMATION

We do not sell your personal information. We only share information in the following ways:

  • Service Providers: We disclose the data listed in Section 1.C to Google LLC (Firebase Crashlytics) strictly for the purpose of crash reporting and application analysis. Google’s use of this data is governed by the Google Privacy Policy. Data may be processed outside Quebec and Canada.

  • Legal Requirements: We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as Quebec Law 25), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement or other governmental agencies.

4. DATA RETENTION

SmartD Technologies does not maintain a central database of user profiles or VFD usage data.

  • VFD Data: Data transmitted to your VFD is stored on the VFD’s physical memory. This retention is governed by your management of the hardware. A factory reset of the VFD will delete this data.

  • Local App Data: Data stored locally on your mobile device remains there until you delete the App or clear its cache.

  • Analytics Data: Anonymized crash data sent to Google Firebase is retained according to Google’s retention policies (generally 90 days).

5. YOUR RIGHTS

Subject to legal or contractual restrictions, you have the following rights regarding your personal information:

  • Access and Correction: The right to access your information and ask for corrections.

  • Withdraw Consent: The right to withdraw consent for data collection (e.g., by uninstalling the App).

  • Portability: You have the right to request the personal information you provided to us in a structured, commonly used technological format. (Note: Since we do not store your data on our servers, “portable” data is limited to what resides on your local device).

6. CHANGES TO OUR PRIVACY POLICY

We may update our Privacy Policy from time to time. If we make material changes to how we treat our users’ personal information, we will notify you by updating the “Last Updated” date at the top of this policy.
